Aunque la marihuana medicinal ahora es legal en Louisiana, todavía es ilegal conducir bajo la influencia de una sustancia, incluso si tiene una receta.
El teniente de la policía estatal Nick Manale dice que se le puede cobrar un DWI bajo cualquier tipo de discapacidad que haga que un conductor opere su vehículo de una manera insegura.
«Ya sea que se trate de alcoholismo, de drogas, medicamentos de venta libre o marihuana medicinal, si ese conductor se siente diferente, entonces va a conducir diferente», dijo Manale.
Un analista legal sugiere que conserve su receta de marihuana medicinal o prueba de su receta cuando viaje si usa marihuana medicinal.
La marihuana medicinal está diseñada para no incluir algunas de las propiedades psicoactivas de la marihuana recreativa, pero Manale dice que su percepción aún puede verse afectada por la sustancia.
«El ingrediente activo seguirá siendo el THC, y sabemos que eso causa efectos, y eso afectará su capacidad de conducción», dijo Manale.
Debido a los efectos del THC, los empleadores aún tienen el derecho legal de negarle trabajo si da positivo, incluso si tiene una receta.
Si está usando marihuana medicinal, Manale dice que sepa que ahora se requiere que los oficiales realicen análisis de sangre en más que solo accidentes fatales, y los resultados podrían usarse en su contra en la corte.
«Cualquier tipo de accidente que los soldados estén investigando que involucre un accidente grave o fatalidad, vamos a obtener una muestra de sangre o muestras de drogas de cada conductor involucrado en ese accidente, ya sea que hayan sido culpables o no», dijo.

Although medicinal marijuana is now legal in Louisiana, it’s still against the law to drive while under the influence of a substance, even if you have a prescription.
State Police Lt. Nick Manale says you can be charged a DWI under any type of impairment that causes a driver to operate their vehicle in a way that is unsafe.
“Whether it is alcohol impairment, drug impairment, over the counter prescription medication, or medical marijuana, if that driver feels different then they are going to drive different.” said Manale.
A legal analyst does suggest that keeping your medical marijuana prescription, or proof of your prescription with you when you travel if you use medical marijuana.
Medical marijuana is designed to not include some of the psychoactive properties of recreational pot, but Manale says your perception can still be impacted by the substance.
“The active ingredient is still going to be THC, and we know that that causes effects, and that is going to effect your driving ability,” Manale said.
Because of the effects of THC, employers still have a legal right to deny you work if you test positive, even if you have a prescription.
If you are using medical marijuana Manale says know that officers are now required to issue blood tests in more than just fatal crashes, and the results could be used against you in court.
“Any type of crash the troopers are investigating involving serious crash or fatality, we are going to obtain a blood sample or drug samples from each driver involved in that crash whether they were the at-fault driver or not,” he said.
